A fee is pre-programmed into the payment system or POS and disclosed upfront as part of the transaction. When configured correctly and transparently, this can be compliant. A surcharge occurs when a business adds or adjusts a charge on the back end to recover credit card processing costs — even if disclosed, this can be classified as a surcharge and become non-compliant if done incorrectly.
Texas law (Business & Commerce Code Chapter 604A) restricts how credit card surcharges may be applied. Improperly passing along processing costs outside of a compliant, disclosed pricing structure can result in violations, even when the intent is transparency.
A pre-programmed device fee is applied automatically at the point of sale as part of a compliant pricing structure. Manual back-end adjustments are inconsistent, often classified as surcharges, and can make revenue reporting appear inflated — impacting taxes even when the amount only offset processing costs.
